Terms and conditions of the Dambimangari Visitors Pass
You acknowledge and agree that:
1. Your Dambimangari Visitors Pass (DVP), issued by the Dambimangari Aboriginal Corporation ICN4691 (”DAC”), is not transferable in any circumstance to any other person, will not be refunded or any portion held in credit for later use.
2. Your DVP provides Dambimangari people’s consent to visit the approved green coded Visitor Sites within Dambimangari country. All other sites, including those sites previously included on the Visitor Location Schedule are prohibited to access. Visitation to sites not included on the Visitor Location Schedule will result in legal action to enforce the rights of the Dambimangari People as Native Title holders.
3. You will need to obtain a transit permit from the Department of Planning, Lands and Heritage for entry to the Aboriginal Reserve areas known as Kunmunya and Wotjalum.
4. You are only permitted to access sites for the period stated on the DVP.
5. You must carry your permit with your at all times and produce or display for inspection your DVP to a Dambimangari Ranger if requested.
6. If you are a tour operator you must hold the required number of DVPs for the capacity of your vessel/vehicle, regardless of the number of passengers on any specific tour.
7. Dambimangari country is a remote natural environment with unpredictable conditions and you acknowledge and agree that your entry and stay on Dambimangari country is entry is entirely at your own risk. You agree to undertake and bear all risk. DAC shall not be under any liability of any kind to you whether in negligence, under statute or otherwise, in respect of death, injury, loss or damage of any kind whatsoever and howsoever arising which occurs during or as a result of entry onto Dambimangari country.
8. Camping is NOT permitted at any locations on Dambimangari land areas, including beach areas.
9. Camp/cooking fires are NOT permitted on Dambimangari country.
10. You must take ALL your rubbish with you. This includes all vegetable peel and seeds and cigarette butts.
11. You must not wash with soaps or detergents in freshwater streams or waterholes.
12. No human waste to be deposited, buried or not, on Dambimangari country.
13. You are not to bring any firearm or hunting weapon such as a crossbow onto Dambimangari country.
14. You are not to bring any animal (including pet or domesticated animal) or plant specimen onto Dambimangari country.
15. You are not to take or collect any living or dead plant or animal specimens from Dambimangari country.
16. You are not to touch any rock art, artefact or human skeletal remains. This includes contact in a confined space by a backpack or any other carried item (e.g. camera tripods, walking sticks).
17. You are not permitted to take photographs, film or reproduce images in any media form for commercial purposes or media sharing platforms without first obtaining written permission from DAC. For the avoidance of doubt this includes uploading images to FaceBook, Twitter and Instagram, personal webpages or any other media sharing platform.
18. You must stay on Visitor Site access tracks and keep within 200 metres of an approved Visitor Site.
19. DAC reserves the right to cancel a DVP for breach of Terms and Conditions. Such persons are no longer welcome and must immediately vacate Dambimangari country.
Dambimangari people are part of a wider community group sometimes called the Wandjina Woongudd community which includes Wunambal, Gaambera, Ngarinyin and other groups. There were three native title determinations to cover all this country – the Wanjina Wunggurr Dambimangari, the Wanjina Wunggurr Willingin and the Wanjina Wunggurr Uunguu Determinations. The Dambimangari Determination area is just part of this larger cultural community in the West Kimberley from the sea inland to the pastoral country of Ngarinyin Traditional Owners.
